This Privacy Policy explains the data collection and use practices of Maytronics Ltd. ("Company" or “We”) in connection with its MyDolphin™ (the “App”) and Company’s website https://www.maytronics.it (the “Website”, together with the App, the “Platform”).

This Privacy Policy governs the privacy terms of the Platform, explains how Company may collect and process information gathered from users or provided by them, how it may share such information, and how You can limit Company's sharing of such information. Any capitalized terms not defined in this Privacy Policy, have the meaning as specified in the Company’s Terms and Conditions of Use.

Collected Information

  1. When You visit the Website, Company automatically collects and stores the following information regarding all visitors:

The IP address of visitor's computer/proxy server used to access the Website;

User Agent and Device Type and Model;

Carrier where applicable;

The type of browser and operating system used to access the Website;

The date and time the Website is accessed, for the purpose of monitoring demand;

The pages visited, for the purpose of improving the usefulness of the Platform by providing helpful links;

The last site visitor visited, if that site contained a link to the Website, which indicates how visitor found the Website;

As a visitor, You can browse the Website to find out more about the Company and You are not required to provide us with any personally identifiable information.

The Platform may use third parties tracking tools to improve the performance and features of the Website. These third party tracking tools are designed to collect only non-personal information about the use of the Platform, but such tools are created and managed by parties outside Company's control. As such, Company is not responsible for any information which is actually gathered by such third parties or for the use and protection of such information by such third parties.

The Website may use Google Analytics to advertise on third party sites to visitors after visitors visited the Website. Visitors can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page.

  1. When You install and use the App, the Company automatically collects and stores the following information:

The IP address of visitor's device/proxy server used to access the App;

User Agent, operation system and Device Type and Model;

Carrier where applicable;

The date and time the App is accessed, for the purpose of monitoring demand;

Exact location.

Company also collects and stores User's Details (as such term is defined in the Terms and Conditions) as voluntarily provided on registration by User, information regarding each User’s access to and usage of the Platform, and/or information that the Users have approved the collection thereof by the Company. A User who provided User's Details will be able to read and/or download Materials, receive information regarding relevant products, order Spare Parts and/or submit warranty claim forms to the Company. User's Details may include information which may enable Company to identify, directly or indirectly, the Users (e.g. first and last name, home, business or other physical address, details regarding products acquired, email address, telephone number).

In addition, the Company collects and stores personal information relating to the contact employee(s) or representative(s) of both applicant and authorized resellers. Such personal information includes name, telephone number and email address. Processing such personal information from individuals at applicant resellers allows the Company to assess and confirm and/or decline an applicant’s suitability to become an authorized reseller and allows the Company to help with the management of its authorized resellers and the terms of its selective distribution system.

The information specified  above shall be collectively referred to as the "Information".

The Platform is not designed for use by anyone under the age of 13 ("Child"), though Company realizes that a Child may attempt to make use of the Platform. Company does not verify the age of Users nor has any liability for verifying a User's age. If You are a parent or guardian and believe Your Child is/was using the Platform, please contact Company at supportMT@maytronics.com to remove Your Child's account; Company reserves the right to ask You for verification of Your relationship to the Child before it honors such a request. If Company discovers (whether independently or upon receiving Your notification) that a Child has created an account on the Platform, it will immediately delete the account as soon as Company discovers such account, it will not use any information gathered from such account for any purpose and will not disclose such information to third parties. However, as parent of such a Child, You understand that You are legally liable for any transactions created by the Child.


How Company uses the Information – Sharing and Disclosure

The following section sets out the purposes for which we use Your Information and the legal basis under the data protection laws on which we rely to do this.

Where there is a LEGITIMATE INTEREST

We may use and process Your Information where it is necessary for us to pursue our LEGITIMATE INTERESTS as a business, or that of a third party. For example:

  • to provide users with a high standard and effective Platform and support tools (including the Maytronics Global Interaction Center), in an attempt to enable the provision of a better and more effective customer service to the Users. In order to do so, Company shall create an internal profile based on the Users' Details;
  • for marketing activities;
  • to correspond or communicate with You;
  • to enable us to provide supply, warranty, support, repair or replacement services;
  • for network and information security purposes;
  • to comply with a request from You in connection with the exercise of Your rights;
  • for the management of queries, complaints or claims;
  • to enable us to verify compliance by resellers with the terms of our selective distribution system, implement, manage, administer and/or otherwise exercise our legal rights under the terms of that system; and
  • for the establishment and defence of our legal rights.

Where You have provided CONSENT

We may use and process Your Information where You have consented for us to do so for the following purposes:

  • contact You if You (i) register for an account with us online or indicate that you would like to receive marketing from us; (ii) sign up to or contact us in respect of warranty, support, repair or replacement services through the Platform or Maytronics’ customer support tools (including but not limited to the Maytronics Global Interaction Center); or (iii) refresh your marketing preferences when responding to a request from us to do so;
  • to provide warranty, support, repair or replacement services through the Platform or Maytronics’ customer support tools (including the Maytronics Global Interaction Center);
  • share Your Information with our recommended third party partners (including but not limited to our resellers) for them to contact you with marketing information; and/or to assist with the provision of warranty, support, repair or replacement services;
  • share Information related to applicant and authorized resellers with distributors of the Company and use such Information in the context of the Company’s selective distribution system and for marketing purposes; and
  • use Your information and contact you for the purposes of implementing and/or administering the Company’s selective distribution system and for marketing purposes.

You may withdraw Your consent for us to use Your Information in any of these ways at any time. Please see the “Your Rights as a Data Subject” section below.

Where there is a LEGAL REQUIREMENT

The Company may share Information or any part thereof with third parties if it believes in good faith that such disclosure will either (a) facilitate compliance with any law regulation or other governmental authority, including, for example, compliance with a court order or subpoena, or (b) protect the safety or security of any person or property, including the service provided by Company, the Website and/or the Platform. Company may also disclose the Information or any part thereof upon a transfer or sale to another entity of all or substantially all of Company's stock or assets. In such events, Company will use commercially reasonable efforts to prevent such third parties from disclosing the Information in contradiction with the terms of this Privacy Policy.

Data Anonymization and Use of Aggregated Information

The Company may use non-personal aggregated information, including such that was derived from Information but anonymized or pseudonymized to remove its personally identifying characteristics ("Aggregated Information") for statistical, research and planning purposes and may retain the Information in order to improve the overall quality of Company's services.

Company retains the right to collect and use the Information and the Aggregated Information in order to improve the Platform and the Company’s services in general. Others who may receive or have access to Your Information

Company may provide User's Details to group companies, affiliates or to third parties that provide services to Company and/or to Users with regard to the Platform or in connection with products and/or services of the Company ordered/purchased by Users (either through the Platform or registered in the Platform (such third parties may include payment processors, Website hosting companies, technical support, fraud detection and prevention services, Company’s business, legal, financial and compliance advisors, etc. – collectively : “Service Providers”); such third parties will only receive information necessary to provide the respective services and will be bound by privacy and confidentiality agreements limiting the use and disclosure of the Information.

Company may provide Information relating to both applicant and authorized resellers to its distributors. Distributors will only receive information necessary to provide their respective services and fulfil their obligations as the Company’s distributors including relating to Company’s selective distribution system and will be bound by privacy and confidentiality agreements limiting the use and disclosure of the Information.


Suggested ads, apps and other third party content

The Platform may provide links to certain third party websites or referrals to certain third parties’ products or services. If You choose to visit a third party’s website or use its products or services, please be aware that Company does not endorse and cannot ensure that You will be satisfied with any such products or services and that the third party’s privacy policy will govern your activities and any information they collect about You and/or You disclose while interacting with the third party.

This Privacy Policy does not apply to websites, ads, applications or services other than the Platform, even if they are embedded in/linked to/presented in the Platform, or to websites, ads, apps or services that display, are subject to, or link to different privacy statements. Please be aware that opting out of this Platform does not necessarily imply that You are opting out of any other third party's website and/or services.

Company strongly encourages You to make whatever investigation You feel necessary or appropriate before proceeding with any online or offline transaction with any third parties. Company is not responsible for any operation or collection of information by any other third party web sites and/or apps.

Please note that certain components of the Information are required in order to activate and operate the Robot through the App and in case You exercise Your Right to be forgotten You will no longer be able to activate and/or operate the Robot through the App.


Storage and Retention

Your Information may be maintained, processed, accessed and stored by Maytronics and our authorized affiliates, Service Providers and business partners in and from the United States of America and other jurisdictions, as necessary for the proper delivery of our services, or as may be required by law.

The Company is based in a jurisdiction which is considered by the European Commission to be offering an adequate level of protection for the personal data of EU Member State residents. Our cloud hosting providers are situated in the United States, and are bound by both contractual requirements and the EU-US and Swiss-US Privacy Shield Framework to ensure proper privacy protections to individuals, regardless of any lesser requirements under US laws.

While privacy laws may vary between jurisdictions, the Company has taken reasonable steps to ensure that Your Information is treated by its affiliates and Service Providers in a secure and lawful manner, and in accordance with common industry practices, regardless of any lesser legal requirements that may apply in their jurisdiction.

We may retain and use the Information as long as You use the App, and thereafter – to the extent necessary for compliance with any applicable legal and/or professional standards and for evidentiary purposes.

We may also use and keep Aggregated Information indefinitely.

Please note that except as required by applicable law, we will not be obligated to retain Your Information for any particular period, and are free to securely delete it for any reason and at any time, with or without notice to You.

We may retain and use Information related to authorized resellers indefinitely, but at least for as long as the reseller continues to sell or promote our products.

Cookies

Like many other websites, our website uses cookies to obtain an overall view of visitor habits and visitor volumes to our website. “Cookies” are small prices of information sent to Your computer or device and stored on its hard drive to allow our website to recognise You when You visit.

Data Controller and Data Processor

Certain data protection laws and regulations, such as the EU GDPR, typically distinguish between two main roles for parties processing Personal Data: the "Data Controller", who determines the purposes and means of processing, and the "Data Processor", who processes the data on behalf of the Data Controller.

Accordingly, Company acts as a "Data Controller", as it collects Information and processes and instructs third parties how to process such Information. Right to erasure – this right, often referred to as the right to be forgotten allows You to ask us to erase personal data where there is no valid reason for us to keep it. Upon receiving such request we shall, subject to any applicable law, take any actions reasonably required in this regard. We may, however, retain such portion of the Information which are reasonably needed in order to comply with legal and/or professional requirements and/or for evidentiary purposes.

Please note that certain components of the Information are required in order to activate and operate the Robot through the App and in case You exercise Your Right to be forgotten You will no longer be able to activate and/or operate the Robot through the App.

Please note also that, once we remove User’s Details, we will no longer be able to provide such User with warranty, support, repair or replacement services through the Platform.

Right to restrict processing – You have the right to ask us to restrict processing of Your data. We will look at any request and inform You of our decision within 28 days of receiving the request.  If You want to exercise this right, please contact us at the contact details above.

Right to data portability – You have the right to move, copy or transfer Your personal Information to a third party. This right applies to Information that You have provided to us and that we are processing. We will respond to Your request within 28 days of receipt of Your request. Please note that once You contact us by e-mail, we may require additional information and documents, including certain Information, in order to authenticate and validate Your identity and to process Your request. Company reserves the right to change this Privacy Policy. We encourage You to review the Privacy Policy regularly for any changes.


No Error-Free Performance

Company will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when Company learns of any failure to comply with it.

Having said that, Company does not guarantee error-free performance under this Privacy Policy. Company may not always be able to prevent an unintended privacy issue, despite its efforts to do so. Accordingly, Company welcomes Your feedback regarding any privacy concerns that You may have, including how Company can improve this Privacy Policy. Despite the fact that Company is following generally accepted standards to protect the Information, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, Company cannot guarantee the Information’s absolute security.
